Minutes of Meeting
Tuesday, September 16, 2014

Member Present: Richard DeBold, Michael Paveglio, Jeffrey Jordan, Town Administrator Jodi Pinard

Others Present: Lucille Noel, Donna Chagnon, Ruthie Hammen, Paul Sanborn, Bernie Reinhardt, Linda Booth, Diane Mobbs, Tom Houle, Philip Hitchcock, Ann Davis

Call to Order: Mr. DeBold called the meeting to order at 6:30pm

Appointments:

Abandon Cemeteries – Notice of Intent - Pursuant to RSA 289:19-21
Mr. DeBold read the Public Notice stating it is the intent of the Town of Chichester to declare the following cemeteries as “abandoned” per RSA 289:19-21 for management and maintenance purposes.

Ruthie Hammen stated the Cemetery Trustees have not heard from any of the descendants of those buried in the following cemeteries that the Trustees have requested be declared abandoned.

Page Cemetery located on Bear Hill Road

Perkins/Maxfield Cemetery located on Pleasant Street next to the mobile home park

True/Shaw Cemetery located Bear Hill Road.

Bernie Reinhardt asked why the town has to take them over.

Ruthie Hammen stated the town does that so that they can legally maintain the cemetery.

A motion was made by Mr. Paveglio and seconded by Mr. Jordan to declare the following cemeteries abandoned per RSA 289:20 III Page Cemetery, Perkins/Maxfield Cemetery, and True/Shaw Cemetery. Motion Passes

Ruthie Hammen stated the Cemetery Trustees would also like to inform of the Board of some cemetery name changes. We are here looking for public input on the following name changes. The Edmounds Stanton Cemetery actually has two names. We would like the smaller portion of the cemetery to stay named Edmunds Stanton and the larger portion to be named the Burying Yard Cemetery. The other name change is for the one on Bear Hill that is named True/Shaw.  The Trustees would like to change it to the True Cemetery.

Mr. DeBold asked the public is they had any input on the name changes.

There was no public input on the name changes.

Linda Booth – Hilliard Road
Ms. Booth stated I had little piece of property that on the town map was football shaped and it was totally useless. I came to Town Hall and questioned why things were happening on this piece of land and found out that a the Warranty Deed that I had signed previously made it so this land was no longer mine and was town owned.

The problem was I thought the property still belonged to me. My concern is every time that Hilliard Road gets widened it always seems to be on my property. Since the town owns the other side I do not understand why they can’t do the work on the town property.

Mr. Paveglio asked if we had done any work on that roadway recently.

Mr. Plunkett stated that he grades the roadway as it exists. We can grade more on the town side of the property.

Mr. DeBold stated that you have made your point that when the road is widened or upgraded that the construction will occur on the town owned side which is the north side of the
road.

Mr. Plunkett asked is there any way that we could possible put pins or some typing of marking so that it is known where the property line is.

Mr. Paveglio asked if the stonewall is still intact.

Ms. Booth stated that yes the stonewall is still intact.

Mr. Plunkett stated that we could establish the right of way on the south side and work towards the north side.

General Business/Board Discussion:

Award Winter Sand Bid

Mr. DeBold reviewed the bids.

FL Merrill                      $5.50 ton
DeCato                  $5.75
Plourde Sand            $9.60

A motion was made by Mr. Jordan and seconded by Mr. Paveglio to award the winter sand bid to FL Merrill in the amount of $5.50 per ton to be delivered to 11 Bear Hill Road.

Outstanding Items:

Map 2 Lot 58-5 Abatement Discussion

Mr. DeBold reviewed the facts of the abatement, it was a gross error on the part of the town.

Mr. Paveglio stated that I have thought about this a lot and it needs to be clearly stated in the meeting minutes as to why the board is making this decision. Attached is the memo to the Board of Selectmen pertaining the reasoning for the decision.

Mr. Jordan stated that he would only go back two years in this case as that was when the resident filed for an abatement. The owner does have some responsibility to this situation as well.

A motion was made by Mr. Paveglio and seconded by Mr. DeBold per RSA 76:16 award an abatement to Map 2 Lot 58-5 $10, 552.64. Motion Passes 2-1

Nomination to CIP Committee

A motion was made by Mr. DeBold and seconded by Mr. Paveglio to nominate Mr. Darren Tapp to the CIP Committee. Motion Passes

Public Input

Ann Davis – Agriculture meeting tomorrow. Garden Club next Wednesday putting the garden to bed workshop will be held in the Grange Hall. I have heard nothing from the CIP Committee.

Philip Hitchcock – I was unaware of a procedure for requesting a check it was explained to me so now I know.

Lucille Noel – Thursday night there is a Lyme Disease Workshop, Book sale on Saturday, Jim looked at the gutters on the library and we are going to work together, regarding the front door we have gotten enough funds in honor of Carolee’s mother to get a custom door made.

A motion was made by Mr. DeBold and seconded by Mr. Paveglio to enter into Non-public session under RSA 91-A:3 II (e) Consideration or negotiation of pending claims or litigation which has been threatened in writing or filed against the public body or any subdivision thereof, or against any member thereof because of his or her membership in such public body, until the claim or litigation has been fully adjudicated or otherwise settled. DeBold Aye, Paveglio Aye, Jordan Aye. Motion Passes

A motion was made by Mr. DeBold and seconded by Mr. Paveglio to exit at 7:40pm non-public session under RSA 91-A:3 II (e). DeBold Aye, Paveglio Aye, Jordan Aye. Motion

A motion was made by Mr. DeBold and seconded by Mr. Paveglio to seal the nonpublic meeting minutes indefinitely. DeBold Aye, Paveglio, Jordan Aye. Motion Passes

A motion was made by Mr. DeBold and seconded by Mr. Paveglio to enter into Non-public session under RSA 91-A:3 II (a) The dismissal, promotion, or compensation of any public employee or the disciplining of such employee, or the investigation against him or her at. DeBold Aye, Paveglio Aye, Jordan Aye. Motion Passes

Road Agent Addendum to Meeting Minutes Request

A motion was made by Mr. Paveglio and seconded by Mr. Jordan to deny the request of Mr. Plunkett to attach an addendum to the meeting minutes of July 29, 2014. Motion Passes

Adjournment

A motion was made by Mr.  Paveglio and seconded by Mr. Jordan to adjourn the meeting at 8:30pm. Motion Passes
